The Federal High Court in Abuja on Tuesday set aside its earlier order revoking the bail granted to Omoyele Sowore, presidential candidate of the African Action Congress (AAC), and vacated the bench warrant issued for his arrest.
Justice Mohammed Umar, in a ruling on Sowore’s application for stay of execution, also set aside the remand order issued against him following his failure to appear in court for his trial on June 16.
The judge had on June 22 ordered Sowore, who is also the publisher of Sahara Reporters, to be remanded in Kuje Correctional Centre pending the hearing and determination of his application for a stay of execution. He had also dismissed an earlier application seeking his recusal from the case over alleged bias.
Justice Umar had revoked Sowore’s bail and issued a bench warrant for his arrest after he failed to appear for trial on June 16, following an oral application by counsel to the Department of State Services (DSS), Mr Akinlolu Kehinde, SAN.
The DSS is prosecuting Sowore over alleged false claims against President Bola Tinubu after he reportedly referred to him as “a criminal” in posts published on his X and Facebook accounts.
